As an entrepreneur focused on building a secure, trustworthy retail environment, keeping our Castleton-on-Hudson community safe and compliant is my personal mission. New York State has established some of the most progressive adult-use cannabis laws in the world, but staying safe requires knowing the boundaries of the Marihuana Regulation and Taxation Act (MRTA).
First, let’s discuss possession limits. Under current New York law, adults aged 21 and older can legally possess up to 3 ounces (85 grams) of loose cannabis flower or up to 24 grams of concentrated cannabis (which includes oils, concentrates, vapes, and edibles) in public at any one time. In your private residence, you are permitted to store up to 5 pounds of loose cannabis, provided it is kept secure and out of reach of minors.
Second, where can you consume? Uniquely, New York law permits the smoking or vaping of cannabis in public anywhere that tobacco smoking is legally permitted under the Clean Indoor Air Act. This means you can consume on public sidewalks and designated outdoor areas. However, consumption is strictly prohibited in motor vehicles (even when parked), public parks, beaches, school grounds, and outdoor dining areas. Always respect your neighbors.
Third, driving under the influence is illegal. It is a misdemeanor crime to operate any motor vehicle while impaired by cannabis. Law enforcement officers in the Capital District are highly trained to detect cannabis impairment, and standard DUI penalties apply. Keep your purchases sealed in their child-resistant exit bags in your vehicle’s trunk or glove box during transport. By respecting these simple boundaries, we protect our community and preserve our hard-won access to safe, tested cannabis.
